Introduction

Welcome to Viz LLM Chart Generator ("Viz LLM," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our web application and its related services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, incorporated herein by reference. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Service Description

Viz LLM is an AI-powered chart generation service that helps researchers and academics create publication-ready visualizations. The Service enables users to generate various types of charts and visualizations which are displayed and can be exported in multiple formats. The Service uses GPT-4o and other AI models to provide intelligent chart generation and formatting capabilities.

3. User Accounts

To use certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

You are responsible for safeguarding your account credentials and for any activities under your account. Notify us immediately of any unauthorized use of your account.

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

4. Credits System and Payments

Credits

Access to AI models within the Service is managed through a credit system. Different AI models may consume a different number of credits per message/interaction, as indicated within the Service.

Subscription Plans

We offer various subscription plans (e.g., Free, Basic, Pro) with different monthly credit allocations and features. Details of each plan are available on our pricing page.

Payment Terms

For paid plans, you agree to pay all applicable fees as described on our pricing page. Payments are processed through a third-party payment processor. You authorize us to charge your chosen payment method.

Billing Cycle

Subscriptions are billed on a monthly basis and will automatically renew unless canceled. Monthly credits are allocated at the start of each billing cycle and typically do not roll over if unused.

Refunds & Cooling-Off Period

For New Paid Subscriptions: If you are a new subscriber to one of our paid plans (Basic or Pro), you may cancel your subscription and request a full refund for any reason within 14 days of your initial purchase (the "Cooling-Off Period"). This Cooling-Off Period applies only to the first time you subscribe to a paid plan. To request a refund under this provision, please contact us at support@vizllm.com within the Cooling-Off Period.

General Refunds: Except for the Cooling-Off Period described above, or as required by law, all fees are non-refundable. We do not provide refunds or credits for any partial subscription periods or unused credits.

Payment Failure & Grace Period

If your recurring payment for a paid plan fails, we will attempt to notify you. We will keep your account on its current paid plan tier for a grace period of seven (7) days from the date of the failed payment to allow you to update your payment information. If payment is not successfully processed within this 7-day grace period, your account will be automatically downgraded to our Free plan. You will lose access to features and credit levels exclusive to your previous paid plan.

Changes to Fees

We reserve the right to change our subscription fees. We will provide you with reasonable prior notice of any changes in fees.

5. Usage Rules

When using our services, you agree to the following:

  • Use Viz LLM Chart Generator for legitimate academic and research purposes only.
  • Do not engage in any unauthorized access, data mining, reverse engineering, or interference with the Service's functionality.
  • Do not compromise the security of our platform or attempt to access user data.
  • Comply with all applicable laws and regulations in your use of the Service.
  • Do not use the Service to generate or share harmful, misleading, or inappropriate content.

6. Intellectual Property Rights

Ownership and usage rights:

  • You retain all rights to the data and content you input into the Service. Generated charts and visualizations are owned by you, subject to these Terms.
  • We grant you a limited, non-exclusive, non-transferable license to use our Service in accordance with these Terms.
  • You may not reverse engineer, decompile, or disassemble any aspect of the Service, or use it to create competing services.
  • Any feedback, suggestions, or ideas you provide about the Service may be used by us without any obligation to you.

7. Data Privacy

We take your privacy seriously. All user data is processed according to our Privacy Policy. Key points include:

  • Your data is stored locally in your browser and is not automatically uploaded to our servers.
  • When using AI features, only the necessary data (such as chart structure and column names) is sent to our AI models. Your raw data remains private unless you explicitly choose to share it for complex chart generation.
  • We use cookies and similar technologies as described in our Cookie Policy.
  • We comply with applicable data protection regulations, including GDPR.

8. Termination

By You

You may terminate your account and these Terms at any time by discontinuing use of the Service and requesting account deletion, if such a feature is available, or by contacting us at support@vizllm.com.

By Us

We may suspend or terminate your access to all or any part of the Service at any time, with or without cause, with or without notice, effective immediately. Reasons for termination may include, but are not limited to, (a) breaches or violations of these Terms, (b) requests by law enforcement or other government agencies, (c) discontinuance or material modification of the Service, or (d) unexpected technical or security issues.

Effect of Termination

Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination shall survive (including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability).

9. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. VIZ LLM DOES NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; (B) THE RESULTS OR ARTIFACTS OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE, RELIABLE, COMPLETE, OR CURRENT; OR (C) ANY ERRORS IN THE SERVICE WILL BE CORRECTED.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL VIZ LLM, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SERVICE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

11. Indemnification

You agree to defend, indemnify, and hold harmless Viz LLM, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Input, any use of the Service's content, services, and products other than as expressly authorized in these Terms, or your use of any information or artifacts obtained from the Service.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Service shall be instituted exclusively in the federal or state courts located in San Francisco, California.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect, for example by posting a notice on our website or sending an email to the address associated with your account. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

14. Miscellaneous

  • These Terms and our Privacy Policy constitute the entire agreement between you and Viz LLM regarding the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
  • No waiver by Viz LLM of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.
  • If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
  • You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
